In these terms and conditions, “we”, “our”, or “company” refers to ozanda.com.au. “You”, “your”, or “customer” refers to the user of ozanda.com.au (including users from Australia and other countries).

By accessing and using ozanda.com.au, you agree to comply with these terms and conditions. We reserve the right to modify these terms at any time. Please read carefully before using our website. If you disagree, please do not use this website.

If you breach any of these terms, we reserve the right to take legal action and terminate your membership (if applicable). We also reserve the right to change the nature of our website or discontinue products and services without prior notice.

Privacy Statement

We respect your privacy. When you register on ozanda.com.au, we collect your personal information to process orders and communicate order status. Your email will be used to send newsletters if you opt-in. We will not sell, rent, or disclose your personal information to third parties.

Membership Registration

  • Members must be 18 years or older.
  • Browsing does not require registration.
  • You are responsible for updating any changes in your personal information.
  • Keep your username and password secure.
  • If you forget your password, you can request a reset.

Email Service

We send newsletters and promotional emails only to subscribers. You may unsubscribe at any time.

Website Content Changes

We reserve the right to change content at any time and cannot guarantee 24/7 uptime. Product images and descriptions are as accurate as possible but may differ from the actual products.

Transaction Terms

  • All prices are in AUD and exclude GST and shipping fees.
  • Orders usually ship within 2-3 business days after payment confirmation (exceptions apply).
  • Delivery times are estimates and not guaranteed.
  • Pre-order items are non-refundable unless defective.

Purchase Process

Customers may browse and select products, add them to the cart, and proceed to checkout. Please confirm product details such as size, material, and purpose before payment. You will receive an order confirmation email after payment.

Payment Methods

  • We accept PayPal, credit cards (Visa and MasterCard only), bank transfers, and cheques.
  • For bank transfers, please send proof to [email protected].
  • Cheque payments must clear before processing orders, which may delay shipping.

Shipping and Delivery

Shipping fees vary by product and destination. Delivery occurs on business days (9am-5pm) excluding weekends and public holidays. Please provide accurate commercial delivery addresses. Incorrect addresses or changes may incur extra fees and risks.

Receipt and Inspection

Please inspect your package and products immediately upon receipt. Report any damage by emailing photos to [email protected] within 7 days. Keep the original packaging for returns.

Pick-up

Pick-up is available at Factory 1, 8 Ailsa Street, Box Hill South VIC 3128 by appointment only. Without prior booking, the warehouse is unattended. Please bring your invoice and photo ID. Third-party pick-up requires written authorization.

Returns and Exchanges

Returns must be initiated within 30 calendar days from the delivery date.

If you change your mind, you may return the item at your own cost, provided it is in original, re-saleable condition.

A 20% restocking and handling fee will apply.

For faulty or misrepresented products, Ozanda will cover return shipping costs in accordance with Australian Consumer Law.

Custom-made products are not eligible for change-of-mind returns. Once production has commenced, orders cannot be cancelled under any circumstances.

In rare cases, we may agree to cancel a custom-made order as a goodwill gesture. Any such cancellation must be initiated by us and is subject to mutual agreement regarding a refund amount, including a deduction of no less than 50% of the customisation cost, based on the stage of production and expenses incurred. If accepted, return requests must be made within 3 days of delivery, and return costs are the customer’s responsibility.

International returns are accepted, but the customer is responsible for all shipping costs and associated risks during transit.

Please do not send returns directly to our warehouse without authorisation, as they will not be accepted. Contact our support team for return instructions.

Online Security

We use reasonable measures to protect your account, but cannot guarantee internet security. Keep your account credentials safe and notify us of any suspicious activity immediately.

Content Upload Policy

Users must not upload illegal, defamatory, harassing, infringing, or spam content. We reserve the right to remove inappropriate content.

Copyright

All website content including images, logos, and text are owned by ozanda.com.au and protected by copyright law. Unauthorized copying or distribution is prohibited.

Website Linking

Users may share website links but must not use our logos or trademarks without permission.

Liability Limitation

To the extent permitted by law, we are not liable for any direct or indirect loss resulting from the use of this website or products, even if advised of the possibility.

Governing Law and Jurisdiction

By using this website and purchasing products, you agree that any disputes, complaints, or claims — whether raised through courts, tribunals, administrative agencies (including consumer protection authorities), or other dispute resolution mechanisms — shall be subject to the exclusive jurisdiction of the competent courts and bodies of Victoria, Australia, to the extent permitted by applicable law.

This clause does not affect your rights under the Australian Consumer Law.

While Ozanda is based in Victoria and these Terms specify Victorian jurisdiction, we are committed to cooperating with investigations by regulatory authorities from other Australian states, including consumer protection agencies, to help resolve disputes and clarify facts. However, such cooperation shall not be interpreted as a waiver of Ozanda’s rights to rely on the governing law and exclusive jurisdiction provisions stated above.

Entire Agreement

These terms constitute the entire agreement between you and ozanda.com.au regarding the use of this website and purchases, superseding all prior agreements.

Severability

If any provision is found invalid or unenforceable, it will be severed, and the remainder will continue in effect.
